Town Board Meeting September 8, 2008


Board members and town officials present: Carol Wingart, Lisa Dowling, Ben Johnson (Supv) Kathy Michell, Lou Meckle, Eileen Falk, Barbara Buckman also Highway Supt George Kinch, Scott Bierny, Water and Sewer Dept, and Dave Sparling, Code Enforcement


Audience; Planning and Zoning Board Chairmen, Linda Slocum, Shorty Strumpfler, Sue Haleck


After usual Division reports from Highway and Water/Sewer, Dave S. Code Enforcement, requested the Board set a moratorium on outdoor woodburning furnaces, which was identified as a need in high density areas, and which has not been addressed due to the Zoning Committee members working on gas drilling task force (as noted, the Board set a public hearing on this)


UDC representative reported on UDC meeting with Damascus Citizens (anti gas drilling group). As our representative, he stated his belief that "people have a right to make money on their land " as long as its done safely, and he expressed hope that this opinion reflected that of the town.


Also he stated that the Upper Delaware Greenway bill has been vetoed by Gov. Paterson.


Then the following Old Business items were addressed:


Eagles Nest road dedication....several people, both Board members, town officials and people in the audience, objected to adopting this road at this time because no one lives there. so the Board passed a motion to suspend current dedication proceedings pending further data.


NYS Retirement (deferred)


New Business:


Craig Burkle was appointed to fill a recently open position on the SC Fire Advisory Board.


Jane Luchsinger was proposed as an alternate member of the Planning Board due to the recent death of Charles Strucker. The Board authorized Chairman Ed Jackson to make the appointment. Georgia Campfield will be filling Mr. Strucker's unexpired term.


Youth Commission ...new members Nancy DeSantos and Jocelyn Strumpfler were congratulated on recent successful events, and were asked by Carol W. and Eileen F. to keep them up to date on Youth Commission activities.


Vital Statistics....The board supported association of Town Clerks who want to continue to issue copies of birth/death certificates locally.


Litterpluck was on the agenda, but was skipped unless I was sleeping.


Public Comment:


More comment (me) against adopting the Eagles Nest "road to no one." Also I asked how long we would have the wide load modular home traffic because it is creating a hazard. Ben said until a bridge crossing I-84 is completed. Chris Holden spoke about how close these fast moving wide loads come to school buses, and this was echoed by Carol Wingart. Others mentioned excessive speed, the fact that the lead car is too close to give a good warning, and that there is sometimes not enough road shoulder pull off....Ben said he would mention to State Police.


Dates for Public Hearings were set as noted above, ...I would check the River Reporter legals for dates/times because sometimes they change between the Meeting and the advertising.

Planning Board Meeting September 15, 2008


Attending: Michael Eury, Shorty Strumfler, Ed Jackson (Chairman) Ken Baim, Jane Luchsinger


Absent: Dick Crandall, Jack Lang, Georgia Campfield


Audience: Bob Weigers, Kathy Michell, Tony Ritter (ZBA Chair) Chris and I, and the owner of the Humphry Road property, and Mr. Sklar (owner, Sklar property on Cackletown Road, and as well as real estate people, the buyer of Sklar property, and an attorney


Public Hearing: Combining lots on Humphrey Road. Gary Packer and the owner, Mr. Kerkulous. This property met zoning regs, but full approval was not given until the owner successfully deals with several violations ( I assume of building codes) .


The public hearing was closed, and regular meeting opened.

Bosser property ....letter from Sull County Planning "does not meet regulations" PUBLIC HEARING on this property is set for October 20, 2008 at 7:20 PM


Updates on Gas Drilling


From David Wright Esq. requesting that the Board sidestep the DEC on Sklar property. The Chairman refused.


DEC letter received this date.....the DEC indicated which "road" they approved, and it was said it was not actually a road, but a right of way. Only one such "road" was approved. Endangered species were discussed and maps reviewed. There was further DEC correspondence regarding Wetland boundaries. these letters were long, technical, and basically outlined the many deed restrictions that will by written by the DEC and will attach to this property.


Agenda:


1. Kerkulous property ....the Board approved motion as noted above.


2. Sklar property....approved motion to remove the Evergreen Road access. (This means that the owner would have to come back to the Planning Board to do any further subdividing) Motion passed to give preliminary approval for a two lot subdivision pending receipt of DEC approval of a new map. So the property will consist of 14 acres and house, and 200 environmentally sensitive acres, which according to the new owner, will be used for hunting.


A PUBLIC HEARING on the Sklar property was scheduled for October 20, 2008 at 7:15PM. assuming all comes back from the DEC
